1. Premises
The Landlord rents to the Tenant the residential premises located at:

The Premises include: [[Parking stall(s) #, storage locker #, appliances/furnishings listed or "standard appliances: refrigerator, stove, dishwasher, washer/dryer if included"]].
The Premises are to be used solely as a private residence for the Tenant and permitted occupants listed in Section 5.
2. Term
The tenancy begins on [[Move-in / Commencement Date]] and ends on [[End Date]] (the "Term"), unless terminated earlier in accordance with the Residential Tenancies Act (RTA) or renewed.
If no fixed end date is specified, the tenancy is month-to-month after any initial fixed term.
Holding over: If Tenant remains after the Term without Landlord consent, the tenancy becomes month-to-month on the same terms subject to RTA termination rules.
3. Rent
Monthly Rent: $[[Monthly Rent]], payable in advance on the [[Rent Due Day, e.g. 1st]] day of each month.
Payment method: [[e-transfer, cheque, direct deposit or other]] to [[Payment Instructions or Landlord account details]].
First month's rent (prorated if applicable): [[Amount and due on signing]].
Rent increases: Governed by RTA; Landlord will provide proper written notice per RTA s. 11 for any permitted increase.
4. Security Deposit
Tenant shall pay a security deposit of $[[Security Deposit Amount]] (not to exceed one month's rent under RTA s. 43) on or before the commencement date.
The deposit is held by the Landlord in accordance with the RTA. The Landlord shall pay interest on the deposit at the rate prescribed by regulation (currently 10% per annum or as updated).
The deposit secures the Tenant's obligations. The Landlord may apply the deposit to unpaid rent, damage beyond reasonable wear and tear, or cleaning required to return the Premises to move-in condition.
Return of deposit: Within 10 days after the Tenant gives up possession, the Landlord must either return the deposit plus interest or deliver a statement of account of any deductions with supporting receipts. If only an estimate is provided, the Landlord must deliver the final statement and any balance within 30 days.
Tenant may not apply the deposit as last month's rent.
5. Occupants and Guests
Permitted occupants: Tenant and [[Names of additional occupants or "no additional occupants"]].
Guests may stay up to [[X consecutive days or total per month]] without Landlord prior written consent. Longer stays require consent and may be treated as unauthorized occupants.
6. Use of Premises
Tenant shall use the Premises only as a private residence, comply with all laws, building rules, and condominium bylaws (if applicable), and not create a nuisance or interfere with the reasonable enjoyment of other residents.
No business or commercial activity is permitted without Landlord's prior written consent.
7. Maintenance and Repairs - Landlord
Landlord shall maintain the Premises in a good state of repair and fit for habitation, comply with all housing and health standards, and keep in good working order all systems and appliances supplied by Landlord (RTA s. 16).
Landlord shall ensure the Premises meet minimum standards under the RTA and any applicable municipal bylaws.
8. Maintenance and Repairs - Tenant
Tenant shall:
- Keep the Premises reasonably clean, sanitary, and safe.
- Use all appliances, plumbing, electrical, and HVAC systems in a proper manner.
- Promptly notify Landlord in writing of any needed repairs or defects.
- Be responsible for damage caused by Tenant, occupants, or guests beyond ordinary wear and tear.
- Replace furnace/air filters, light bulbs, and batteries in smoke/CO alarms as needed.
- Not make alterations or additions without prior written consent.
9. Entry by Landlord
Landlord may enter the Premises:
- In case of emergency without notice.
- To inspect, make repairs, or show to prospective tenants/purchasers, with at least 24 hours' written notice between the hours of 8:00 a.m. and 8:00 p.m. on a weekday, or at another reasonable time agreed by Tenant (RTA s. 23).
Tenant shall not unreasonably withhold consent to entry for lawful purposes.
10. Utilities and Services

Tenant shall maintain utilities in Tenant's name from move-in date and shall not allow disconnection.
11. Insurance
Tenant is strongly advised (and may be required by Landlord rules) to maintain tenant's insurance including personal property, liability, and additional living expenses.
Landlord's insurance does not cover Tenant's personal property or liability.
12. Pets

If permitted, Tenant is fully responsible for any damage, odors, or nuisance caused by pets.
13. Smoking and Other Policies

No illegal activity is permitted on the Premises.
14. Default and Termination by Landlord
Tenant is in default if Tenant:
- Fails to pay rent when due.
- Breaches any material term of this Agreement.
- Causes serious damage or danger.
Landlord may terminate in accordance with the RTA by serving the appropriate written notice on the prescribed form (via RTDRS):
- Non-payment of rent: 14-day notice (or as updated).
- Other breach: notice allowing cure period where required.
- For cause (damage, disturbance): shorter or unconditional notice as permitted.
Landlord may apply to the Residential Tenancy Dispute Resolution Service (RTDRS) or Court for an order of possession if Tenant does not vacate.
15. Termination by Tenant
Tenant may terminate at the end of the Term or month-to-month by giving proper written notice per RTA timelines (generally one full rental period).
Early termination: Tenant remains liable for rent until the end of the Term or until new tenant is secured (mitigation by Landlord).
16. Move-Out and Surrender
At end of tenancy Tenant shall:
- Remove all personal property and debris.
- Return all keys, fobs, and access devices.
- Leave the Premises reasonably clean and in the same condition as move-in, allowing for ordinary wear and tear.
- Provide forwarding address in writing.
Landlord shall conduct a move-out inspection with Tenant if requested and provide a written statement of the condition.
17. Assignment and Subletting
Tenant shall not assign this Agreement or sublet the Premises without the Landlord's prior written consent (which shall not be unreasonably withheld).
18. Rules and Regulations; Condominium
Tenant shall comply with the Landlord's reasonable written rules attached as Schedule A (if any) and any condominium or building bylaws.
Landlord may amend rules on reasonable notice.
19. Damage or Destruction
If the Premises are damaged so as to be uninhabitable and not caused by Tenant, rent abates proportionately. Either party may terminate if repairs cannot reasonably be completed within a reasonable time under RTA.
20. Default Remedies and Costs
If Tenant defaults, Landlord may pursue all remedies under the RTA and law, including recovery of possession, unpaid rent, damages, and reasonable costs.
21. Notices
All notices under this Agreement or the RTA shall be in writing and delivered personally, by registered mail, or by any other method permitted by the RTA to the addresses above or such other address as a party may designate in writing.
22. Severability and Entire Agreement
If any provision is invalid, the remainder remains in effect.
This Agreement, including any schedules and the RTA, constitutes the entire agreement. No modification is binding unless in writing signed by both parties.
23. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Alberta and the Residential Tenancies Act (SA 2004 c R-17.1) as amended.
Disputes are resolved through the Residential Tenancy Dispute Resolution Service (RTDRS) or the appropriate Court.
