1. Premises
Landlord leases to Tenant the residential property at [[Property Full Address, Unit #, City, Arizona ZIP]] (the "Premises"), including any parking space [[# or description]] and appliances listed in Schedule B.
Premises to be used exclusively as a private residence.
2. Term
Initial Term begins [[Start Date]] and ends [[End Date]]. Thereafter, unless terminated, the tenancy converts to month-to-month on the same terms.
3. Rent

4. Security Deposit (A.R.S. § 33-1321)

Tenant may not treat deposit as last month's rent.
5. Late Fees and NSF
If rent is not received within the grace period stated in Arizona law or this Lease (commonly 5 days in many agreements), a reasonable late fee may apply as disclosed.

6. Utilities and Services

9. Landlord's Maintenance Obligations (A.R.S. § 33-1324)
Landlord shall maintain the Premises in a habitable condition, comply with applicable codes, and keep structural components, plumbing, electrical, HVAC, and supplied appliances in good working order.
10. Tenant's Maintenance Obligations (A.R.S. § 33-1341)
Tenant shall keep Premises clean and safe, dispose of trash properly, use facilities appropriately, and promptly notify Landlord of defects.
Tenant is responsible for damage caused by misuse or neglect.
11. Landlord's Right of Entry (A.R.S. § 33-1343)
Landlord may enter:
- In an emergency without notice.
- To make repairs, inspect, or show the Premises, with at least 48 hours' advance written notice (or 24 hours in some interpretations; Landlord will provide reasonable notice) during reasonable hours.
Tenant shall not unreasonably withhold consent.
12. Pets

13. Smoking

14. Default and Remedies (A.R.S. § 33-1368)
Nonpayment of rent: Landlord may serve a 5-business-day notice to pay rent or quit.
Other breach: 10-day notice to cure or quit (or 5-day for health/safety violations).
Landlord may terminate and recover possession through court process. No self-help evictions (lockouts, utility shutoffs) permitted.
Tenant remains liable for rent due under the Lease, subject to Landlord's duty to mitigate.
15. Termination and Holdover
Month-to-month: either party may terminate with proper written notice (30 days typical, or as required by law).
Fixed term: notice required per Lease end or conversion terms.
Holdover: Tenant becomes month-to-month or may be subject to holdover damages and eviction.
16. Assignment and Subletting
No assignment or sublease without prior written Landlord consent (not to be unreasonably withheld).
17. Casualty and Condemnation
If Premises destroyed or substantially damaged by casualty not caused by Tenant, rent abates. Either party may terminate if repair is not feasible within a reasonable time.
18. Required Disclosures
Lead-Based Paint (pre-1978 housing): See attached EPA pamphlet and disclosure (42 U.S.C. 4852d). Tenant acknowledges receipt.

19. Renter's Insurance

21. Attorney Fees
In any action to enforce this Lease, the prevailing party is entitled to reasonable attorney fees and costs per A.R.S. § 12-341.01 or other applicable law.
22. Notices
All notices shall be in writing and delivered as permitted by A.R.S. § 33-1313 (personal delivery, certified mail, or other authorized method) to the addresses in this Lease or as updated in writing.
23. Severability; Waiver; Entire Agreement
Invalid provisions do not affect the rest. No waiver unless in writing. This Lease + attachments is the entire agreement.
24. Governing Law
Arizona law governs. Venue in the county where the Premises are located.
25-30. Standard Boilerplate (Full Provisions)
25. Waiver of Jury Trial. To the extent permitted, parties waive jury trial in any dispute.
26. Binding Effect. This Lease binds heirs, successors, and permitted assigns.
27. Time of Essence. Time is of the essence in all performance obligations.
