Tenant's Right to Avoid Eviction (10-Day Notice - RTA s. 46):
This is a 10-day notice. You have 5 days from receipt of this notice to pay all arrears in full or dispute this notice by applying to the Residential Tenancy Branch. Part 4 - Tenant's Rights and Dispute Process
- Right to Dispute: A tenant may dispute this notice by applying to the Residential Tenancy Branch (RTB) online at www.gov.bc.ca/residential-tenancy or by telephone at 604-660-1020 (Lower Mainland) or 1-800-665-8779 (toll-free).
- Dispute Deadline for Non-Payment Notices (Option A): You must apply to the RTB within 5 days of receiving this notice to dispute it. Missing this deadline means the landlord may apply for an Order of Possession after 10 days.
- Dispute Deadline for Other Notices (Options B, C, D): Apply to the RTB before the tenancy end date stated in this notice.
- If You Vacate Voluntarily: If you choose to vacate before the tenancy end date, you are entitled to a proportionate refund of any prepaid rent.
- Security Deposit: Your security deposit (and pet damage deposit if applicable) must be returned within 15 days after the tenancy ends and the tenant provides a forwarding address, unless the landlord applies to the RTB for deductions (RTA s. 38).
