Indiana Code Title 32, Article 31 (Landlord-Tenant Relationships) governs eviction notices. Select the notice type that matches the grounds for eviction. Using the wrong notice type or notice period will invalidate the notice and require you to restart the process.

Eviction Filing (Small Claims / Superior Court)
If the tenant fails to comply with the notice, Landlord may file an Eviction Complaint (Small Claims - Case Type SC) in the [[County]] County Circuit/Superior Court for the county where the rental property is located. Filing fees vary by county (approximately $100-$175 as of 2026 - verify with the clerk). Landlord may request:
- Restitution of the premises (eviction);
- Judgment for unpaid rent and damages; and
- Costs of the action.

Retaliation Warning
Indiana law (I.C. § 32-31-3-14) prohibits landlords from retaliating against tenants for exercising their legal rights (e.g., reporting code violations, organizing tenants). Issuing an eviction notice in retaliation is unlawful.
