1. Storage Unit
Landlord leases to Tenant the residential premises located at [[Property Address]], including unit [[Unit Number if applicable]], City of [[City]], South Dakota [[ZIP]] (the "Storage Unit"). The Storage Unit include the dwelling unit and any assigned parking, storage, or other appurtenances described in this Agreement.
2. Term
The Lease Term begins on [[Lease Start Date]] and ends on [[Lease End Date]], unless sooner terminated or extended as provided herein. If the Term begins on a day other than the first of the month, Rent for the partial month shall be prorated.
3. Rent
Tenant shall pay monthly Rent of [[Monthly Rent Amount]], due in advance on the [[Due Day, e.g. 1st]] day of each month. Rent shall be paid to Landlord at [[Payment Address or Method, e.g. mailed to address or via portal]] or such other place as Landlord may designate in writing.
4. Security Deposit
Upon execution of this Agreement, Tenant shall pay a security deposit of [[Security Deposit Amount]]. Landlord shall hold the deposit in accordance with South Dakota law. Landlord shall return the deposit, less any lawful deductions, within thirty (30) days after termination of the tenancy and Tenant's vacating the Storage Unit, together with an itemized statement of any deductions. The deposit secures performance of Tenant's obligations.
5. Late Fees and Returned Payments
If Rent is not received by the due date, a late fee of [[Late Fee Amount or %]] may be charged after any grace period provided in the lease or by law. A fee of [[NSF Fee]] applies to any returned payment.
6. Utilities and Services
Tenant shall be responsible for payment of [[List Tenant-Paid Utilities]]. Landlord shall be responsible for [[List Landlord-Paid]]. Tenant shall not allow utilities to be disconnected.
7. Use of Storage Unit; Occupants
The Storage Unit shall be used solely as a private residence by Tenant and the following additional authorized occupants: [[List Additional Occupants or "none"]]. No other persons may reside without Landlord's prior written consent. Guest stays longer than [[Guest Limit Days]] consecutive days require consent.
Tenant shall not permit any activity that disturbs the peaceful enjoyment of neighbors, violates law, or creates a nuisance. Tenant shall comply with all laws, ordinances, and HOA rules if applicable.
8. Maintenance and Repairs
Landlord shall maintain the Storage Unit in a habitable condition in compliance with applicable housing codes. Tenant shall keep the Storage Unit clean, sanitary, and in good order; promptly notify Landlord of needed repairs; and be responsible for damage caused by Tenant's negligence or misuse beyond ordinary wear and tear.
9. Alterations
Tenant shall not make any alterations, additions, or improvements to the Storage Unit without Landlord's prior written consent.
10. Pets
Pets: [[Pet Policy: No pets without prior written consent; or describe allowed pets, deposits, fees]]. Tenant is liable for any damage caused by pets.
11. Entry by Landlord
Landlord may enter the Storage Unit with reasonable notice (24 hours except in emergencies) for inspection, repairs, to show to prospective Renters or buyers, or as otherwise permitted by South Dakota law.
12. Default and Remedies
If Tenant fails to pay Rent or violates any term of this Agreement, Landlord may give notice as required by law and pursue eviction and other remedies available under South Dakota Residential Landlord and Tenant Act, including recovery of possession, unpaid rent, damages, and costs.
13. Assignment and Subletting
Tenant shall not assign this Agreement or sublet the Storage Unit without Landlord's prior written consent.
14. Governing Law
This Agreement shall be governed by the laws of the State of South Dakota. Any legal action shall be brought in the courts of [[County]], South Dakota.
15. Entire Agreement; Severability
This Agreement, together with any addenda and exhibits, constitutes the entire agreement. If any provision is held invalid, the remainder shall remain in effect.
16. Notices
All notices shall be in writing and delivered as specified in the lease or by law.
17. Lead-Based Paint Disclosure (If Pre-1978)
If the Storage Unit were built before 1978, Landlord provides the required lead-based paint disclosure and pamphlet as required by federal law. Tenant acknowledges receipt.
18. Move-In / Move-Out
Tenant has received the Move-In/Move-Out Checklist. Tenant shall complete and return it within the required time. Landlord will conduct a move-out inspection after Tenant vacates and provide an itemized accounting of any deductions from the security deposit within the statutory period.
19. Default Remedies Detail
- If Tenant is in default for non-payment of rent, Landlord may terminate after proper statutory notice and pursue all remedies.
- If Tenant commits waste, nuisance, or illegal activity, Landlord may terminate with shorter or no cure period as permitted by law.
- Tenant waives no rights but acknowledges that repeated late payments may constitute grounds for non-renewal or termination.
20. Indemnification
Tenant agrees to indemnify and hold Landlord harmless from claims arising from Tenant's use of the Storage Unit or breach of this Agreement, except to the extent caused by Landlord's negligence or willful misconduct.
21. Rules and Regulations
Tenant agrees to comply with any reasonable rules and regulations attached hereto or posted for the property, as they may be updated with notice.

22. Waiver
No waiver of any breach shall constitute a waiver of any subsequent breach. Landlord's acceptance of Rent with knowledge of a breach does not waive the right to enforce remedies for that or future breaches.
