Article I. Revocation of Prior Wills and Codicils
I revoke all wills and codicils previously executed by me. This Will is intended to be my sole testamentary instrument.
Article II. Family Information and Definitions
- My spouse (if any): [[Spouse Full Legal Name or "None"]].
- My children (living and deceased with surviving issue noted): [[List full names, dates of birth or "None"]].
- Any other beneficiaries or interested persons: [[List names and relationships or "None"]].
For purposes of this Will, references to "my children" or "issue" include adopted children and their descendants unless otherwise specified.
Article III. Appointment of Executor and Alternate
I appoint [[Primary Executor Full Legal Name]], of [[Executor Address, City, State ZIP]], as Executor of this Will.
If the above Executor is unable or unwilling to serve or continue to serve, I appoint [[Alternate Executor Full Legal Name]], of [[Alternate Executor Address]], as Alternate Executor with the same powers, duties, and discretions.
The Executor shall have full power and authority to:
- Sell, lease, mortgage, or otherwise deal with any real or personal property of my estate without court order to the extent permitted by Vermont law.
- Invest and reinvest estate assets in any property or securities.
- Compromise, settle, or adjust any claims in favor of or against the estate.
- Execute all necessary documents, deeds, and instruments.
- Pay debts, taxes, and administration expenses from estate assets.
- Make distributions in cash or in kind at fair market value.
I request that no bond or other security be required of any Executor or Alternate serving under this Will, to the maximum extent permitted by Vermont law (14 V.S.A. Title 14).
Article IV. Appointment of Guardian for Minor Children
If any of my children are minors at the time of my death and my spouse does not survive me or is unable to serve, I nominate and appoint [[Guardian Full Legal Name]], of [[Guardian Address]], as Guardian of the person and property of such minor children.
If the above Guardian is unable or unwilling to serve, I appoint [[Alternate Guardian Full Legal Name]] of [[Alternate Guardian Address]] as Alternate Guardian.
The Guardian shall have custody and control of the persons of my minor children and authority over their education, health, and welfare consistent with Vermont law. A separate guardian of the estate may be appointed if needed.
Article V. Payment of Debts, Expenses, and Taxes
I direct my Executor to pay from my estate all my legally enforceable debts, funeral and burial expenses, costs of administration, and any estate, inheritance, or other death taxes (including interest and penalties) that may be assessed against my estate or any beneficiary, in such manner and from such assets as the Executor deems appropriate, without requiring contribution from any beneficiary.
Article VI. Specific Bequests and Devises
I make the following specific gifts:
- To [[Beneficiary 1 Full Name]], I give [[Description of specific item, real property address, or sum of money, e.g., my 2018 Honda Civic VIN XXXXX or $5,000 cash]].
- To [[Beneficiary 2 Full Name]], I give [[Description]].
- To [[Beneficiary 3 Full Name]], I give [[Description]].
If any specific beneficiary named above does not survive me, the gift to that beneficiary shall lapse and become part of the residuary estate, unless otherwise provided.
Any property not effectively disposed of by the above specific bequests shall pass under the residuary clause below.
Article VII. Residuary Estate
I give, devise, and bequeath all the rest, residue, and remainder of my estate, of whatever kind and wheresoever situated, of which I shall die seized or possessed or to which I may be entitled at the time of my death (the "Residuary Estate"), to the following persons in the following shares, or to their issue by right of representation if any predecease me:
- [[Residuary Beneficiary 1 Full Name]] - [[Percentage or fractional share, e.g., fifty percent (50%)]].
- [[Residuary Beneficiary 2 Full Name]] - [[Percentage or fractional share]].
- [[Residuary Beneficiary 3 Full Name]] - [[Percentage or fractional share]].
If no residuary beneficiaries or their issue survive me, then my Residuary Estate shall be distributed to my heirs at law as determined under Vermont intestate succession laws (14 V.S.A. Chapter 1 or successor).
Article VIII. No-Contest Clause
If any beneficiary under this Will, or any person claiming through or under any such beneficiary, directly or indirectly contests or attacks this Will or any of its provisions, or joins with or assists anyone in doing so, then such beneficiary shall receive no portion of my estate, and the share that would otherwise have passed to such beneficiary shall instead be added to and distributed as part of the Residuary Estate as if that beneficiary had predeceased me without surviving issue.
This clause shall not apply to any good-faith challenge to the validity of the Will brought by a court-appointed fiduciary or to enforce court interpretation.
Article IX. Simultaneous Death and Survival
If any beneficiary and I die under circumstances where it cannot be determined who survived the other, or if any beneficiary fails to survive me by thirty (30) days, such beneficiary shall be deemed to have predeceased me for all purposes of this Will.
Article X. Powers of Appointment and Discretionary Provisions
[[If applicable: I grant my Executor or any Trustee discretion to make distributions for the health, education, maintenance, and support of any beneficiary in such amounts and at such times as they deem appropriate, considering other resources available to the beneficiary.]]
