Notice Selection and Statutory Basis
Select the appropriate notice type below. West Virginia recognizes several statutory notice periods depending on the nature of the tenancy and the breach.
- Notice to Pay Rent or Quit (non-payment): Commonly five (5) days for non-payment of rent under W. Va. Code § 37-6-19 and unlawful detainer procedures in § 55-3A-1 et seq. The notice must demand the exact rent due.
- Notice to Cure or Quit (other breach): For material breach other than rent (e.g. unauthorized pets, damage, nuisance, unauthorized occupants). Tenant is given opportunity to cure within the period stated (often set by lease or reasonable time, typically aligned with 5-30 day practice depending on violation).
- Notice to Vacate (no-fault or end of tenancy): For termination of month-to-month tenancy, W. Va. Code § 37-6-5 generally requires one (1) calendar month notice for month-to-month tenancies. Week-to-week may require seven (7) days. Fixed term leases end per their terms without additional notice unless holdover.
- Unconditional Notice (limited circumstances): For certain serious violations or holdover after proper termination; specific grounds must support dispensing with cure period.

Tenant Rights and Important Information
Tenant has the following rights under West Virginia law:
- The right to pay the full rent demanded within the notice period to cure a pay-or-quit notice.
- The right to cure certain breaches within the cure period if this is a cure-or-quit notice.
- The right to receive proper notice and service before any court eviction action.
- The right to defend in magistrate or circuit court, including raising defenses such as improper service, payment or waiver by acceptance of rent after breach, breach of habitability by landlord, retaliation, or other legal defenses.

Tenant should not ignore this notice. Failure to pay, cure, or vacate by the deadline may result in a court action for possession and a money judgment.
Landlord Requirements and Prohibitions
Landlord must:
- Use the correct notice form and state accurate facts and amounts.
- Serve the notice properly and retain proof of service.
- Wait the full notice period before filing an unlawful detainer action.
- File in the proper court (usually magistrate court in the county where the property is located) using the required complaint and supporting documents.
- Comply with all court procedures, including any required pre-filing notices or mediation.
Landlord is strictly prohibited from self-help evictions. Changing locks, shutting off utilities, removing doors or property, or threatening or harassing tenants to force vacating without a court order is illegal and may result in significant damages, penalties, and attorney fee awards against the landlord.
Court Process Overview (for Landlord After Notice Expires)
If Tenant remains after the deadline:
- Prepare and file a complaint for unlawful detainer in the appropriate magistrate court, attaching a copy of the notice and proof of service.
- Pay any required filing fees.
- Obtain a hearing or trial date; the court will issue notice to Tenant.
- Attend the hearing and present evidence of proper notice, service, grounds, and amounts due.
- If judgment for possession is granted, obtain a writ of possession after any applicable stay or appeal period.
- Arrange for sheriff or constable execution of the writ if necessary. Landlord may not forcibly remove tenant without the writ.
Additional Statutory Notes
- West Virginia does not have statewide rent control or just-cause eviction requirements for most private rentals (local rules may differ).
- Security deposit claims are separate from eviction for possession; use proper accounting procedures under W. Va. Code § 37-6A.
