I, [[Seller Full Legal Name]] (Seller), state that the odometer of the vehicle described above reads:
[[Odometer Reading]] kilometres at the time of sale.
To the best of my knowledge:
- [ ] The odometer reading reflects the actual mileage of the vehicle.
- [ ] The mileage stated is in EXCESS of the mechanical limits of the odometer (the odometer has rolled over).
- [ ] The odometer reading is NOT the actual mileage - WARNING: ODOMETER DISCREPANCY.
Providing a false odometer statement may constitute an offence under applicable federal and provincial law.
Seller Signature (Odometer): ______________________________ Date: _________
Buyer Acknowledgment: I acknowledge receipt of the above odometer disclosure.
Buyer Signature (Odometer): ______________________________ Date: _________
5. "As-Is" Disclaimer / Condition
The vehicle is sold in its present condition "as is, where is," with no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, EXCEPT for any statutory warranty that cannot be excluded under applicable law.
Known Defects Disclosed by Seller (if any):
[[Describe any known defects or mechanical issues, or "None disclosed by Seller"]]
The Buyer acknowledges that they have had the opportunity to inspect the vehicle (and to obtain an independent inspection) and accepts the vehicle in its current condition.
6. Title, Liens, and Encumbrances
Seller warrants that:
(a) Seller is the registered owner of the vehicle and has the legal right to sell it;
(b) The vehicle is free and clear of all liens, charges, and encumbrances registered against it EXCEPT:
[[List any existing lien with lienholder name and file number, or "None"]]
(c) If a lien exists, Seller shall obtain a discharge from the lienholder and provide evidence of discharge to Buyer within [[Number]] days of the sale date. The Buyer is advised to conduct a vehicle lien search through the Personal Property Registry (PPR) at ppr.gov.bc.ca before completing purchase.
Note: In British Columbia, outstanding liens registered against a vehicle on the Personal Property Registry (PPR) can be enforced against the vehicle even after sale to a buyer who had no actual knowledge of the lien.
7. Provincial Sales Tax (PST) and Insurance
7.1 PST (British Columbia): The sale of a used motor vehicle between private individuals in BC is subject to BC Provincial Sales Tax (PST) at the rate applicable to the vehicle's value as determined by the BC Ministry of Finance (currently 12% of the greater of the purchase price or the vehicle's value per ICBC's Vehicle Valuation Guide - verify current rate at gov.bc.ca/pst). The Buyer is responsible for paying PST at the time of transferring registration through an Autoplan broker or ICBC.
7.2 ICBC Insurance: The Buyer must arrange ICBC basic autoplan insurance before driving the vehicle in BC. The Seller is responsible for cancelling or transferring existing ICBC insurance.
8. British Columbia Title and Registration Transfer Procedure
To complete the transfer of ownership in British Columbia, the Buyer must:
- Obtain a signed APV9T form (Transfer/Tax Form) from an Autoplan broker - both Seller and Buyer must complete and sign this form. This form is available at any ICBC Autoplan broker.
- Bring this Bill of Sale and the signed APV9T form to an Autoplan broker.
- Pay PST on the vehicle (assessed by the Autoplan broker based on purchase price or ICBC valuation, whichever is greater).
- Register the vehicle in the Buyer's name and obtain new BC registration documentation.
- Arrange insurance before driving the vehicle.
- The transfer must be completed within [[10 working days]] or as required by ICBC policy - verify the current deadline with ICBC.
7. Seller should:
- Keep a copy of this Bill of Sale and the APV9T;
- Return any remaining portion of the ICBC plate transfer or cancel insurance;
- Remove the BC licence plates (plates stay with the registered owner, not the vehicle, in BC).
9. Release of Liability
From and after the date and time of sale, Seller releases all responsibility and liability for the vehicle, including any traffic violations, accidents, or other incidents occurring after the time of transfer. Seller retains the BC licence plates.
10. Governing Law
This Bill of Sale is governed by the laws of the Province of British Columbia. Any dispute shall be resolved in the courts of British Columbia, in the jurisdiction of [[City, BC]].
11. Entire Agreement
This document constitutes the entire agreement between the parties regarding the sale of the vehicle. No oral representations, warranties, or side agreements not set forth herein are binding.
